These terms and conditions apply to all artist membership subscriptions to RiverArt, by subscribing to this website you are agreeing to comply to these terms
The term "RiverArt" www.riverart.co.uk
, "RiverArt", "us" or "we" refers to the owner of the website, address : 120 Stour Rd, Christchurch, Dorset, England BH23 1JP. The term "you" refers to the artist member, user or viewer of our website.
Membership Of RiverArt
To subscribe to this site as an artist you must be over 18 years of age and a resident of the UK, Europe EU or USA, we will only accept individual artists who are self-representing
You warrant that the personal information you must provide when registering as an artist or customer is true, accurate, current and complete in all respects. You agree not to impersonate any other person or entity or to use any false name or any name that you are not authorised to use.
We reserve the right to decline any artists application or terminate an artists membership at any time
Once you are accepted as a member artist you will receive an email
confirming your membership with RiverArt, you will be entering into a
legally binding contract with us and your membership to our service
We charge a commission fee of 25% on your art sales or commissions
We reserve the right to not display or remove any images or text that are inappropriate, not family friendly, or images that are of very poor quality and therefore do not accurately represent the item for sale will not be accepted
PaymentsWhen you make a sale you will be sent payment less 25% commission
If you are unhappy with our service for any reason you may cancel your membership at anytime
Your Membership Obligations
'You' 'The Artist' 'Seller' agree to adhere to the following:
Photos of your artwork must as accurately as possible represent the artworks for sale (within reasonable limits i.e. different monitor settings/image compression factors)
Please have a minimum of 2 artworks in your gallery available to buyers for your account to remain active, these can be commissions if you have no art available for sale at this time
Delete or edit your artwork and change the availability to: 'sold', 'reserved', or 'example' artworks which are no longer available
Despatch in stock artworks to the buyer within 7 working days of receiving the order
(commissions excluded) let us know if you expect a delay
The Buyer has 7 days to inform 'You' if an artwork is to be returned and a further 7 days - 14 days in total to return the artwork for a refund (refunds do not include P&P unless the artwork has been damaged in transit)
Place links to your other website(s) on your links page
Quality of Goods
In accordance with the Sale of Goods Act, the 'Seller' must supply Goods which are of a satisfactory quality. This means Goods must be of a standard that a reasonable person would regard as satisfactory, the description of the goods, fitness for the purpose for which goods of the kind are supplied, and the appearance and finish, therefore the Seller will ensure that the Goods will correspond to the description given by the Seller at the time of despatch.
Rights of Seller
The ' Seller' reserves the right to amend the price and specification of any goods advertised on their gallery pages here at Riverart at any time.
The ' Seller' reserves the right to withdraw any goods from their gallery pages here at RiverArt at any time.
Despatch, Delivery or Collection
The 'Seller' agrees to the following:
The Goods must be safely & securely packed to prevent damage in transit and a reliable insured courier or delivery method must be used.
The Buyer must inspect the Goods immediately upon receipt and must notify the 'Seller' within 48 hrs of delivery if the Goods are damaged or do not comply with the Contract. If the Buyer fails to notify the 'Seller' within 14 days then the Buyer will be deemed to have fully accepted the Goods.
If the Goods are damaged or defective, the Goods will be returned by the Buyer to the 'Seller'. The Buyer will be entitled to receive a full refund (including delivery costs) plus the postal cost of returning the Goods by insured delivery.
If you are a Consumer, you have the right, in addition to any other statutory rights, to cancel the Contract and receive a refund by informing the 'Seller' in writing or by email within 7 working days of receipt of the Goods. In this instance, Goods must be returned at the Buyers own cost and should be sent by insured delivery. The Buyer will receive a full refund of all monies paid for the Goods (less delivery charges) within 30 days of cancellation.
When any Goods are returned the Buyer must notify the Seller that the Goods are to be returned and return the goods within 14 days
If returned Goods are found to be damaged which is the fault of the Buyer, the Buyer will be liable for the cost of repairing such damage.
The Website Owner is not responsible for any material submitted to the public areas by you (which include bulletin boards, hosted pages, chat rooms, or any other public area found on the website. Any material (whether submitted by you or any other user) is not endorsed, reviewed or approved by the Website Owner. The Website Owner reserves the right to remove any material submitted or posted by you in the public areas, without notice to you, if it becomes aware and determines, in its sole and absolute discretion that you are or there is the likelihood that you may, including but not limited to -
1. defame, abuse, harass, stalk, threaten or otherwise violate the rights of other users or any third parties;
2. publish, post, distribute or disseminate any defamatory, obscene, indecent or unlawful material or information;
You further agree not to use the website to send or post any message or material that is unlawful, harassing, defamatory, abusive, indecent, threatening, harmful, vulgar, obscene, sexually orientated, racially offensive, profane, pornographic or violates any applicable law and you hereby indemnify the Website Owner against any loss, liability, damage or expense of whatever nature which the Website Owner or any third party may suffer which is caused by or attributable to, whether directly or indirectly, your use of the website to send or post any such message or material.
3. post or upload files that contain viruses, corrupted files or any other similar software or programmes that may damage the operation of the Website Owner's and/or a third party's computer system and/or network;
4. violate any copyright, trade mark, other applicable Great Britain or international laws or intellectual property rights of the Website Owner or any other third party
You agree to indemnify and hold us harmless from any claims, damages, expenses, legal fees, incurred by us or arising out of or in connection with your artwork or products, activities or the content of your individual gallery, including, without limitation, any actual or alleged infringement of copyright or other intellectual property rights.

Any reliance you place on such information is therefore strictly at your own risk.

'We' or the 'artists' use return email addresses to answer the email we receive. Such addresses are not used for any other purpose and are not shared with outside parties.
You can register with our website if you would like to receive updates on our new products and services. Information you submit on our website will not be used for this purpose unless you fill out the registration form.
Finally, we never use or share the personally identifiable information provided to us online in ways unrelated to the ones described above without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.
